By accepting these terms, you represent and acknowledge that you have read, understood and agree to be bound by these terms.

You declare that you are over 18 years old, and that the information you provide when registering on textbuler.com is accurate, complete and entitles you to use the tool. If you are registering on textbulker.com on behalf of a corporation or other legal entity, you represent that you have the authority to bind that entity and its affiliates to these Terms; in which case the terms "you", "your", or associates shall refer to this entity and its affiliates.

If you do not have such authority, or if you do not meet these terms, you must opt out of the terms and use of the textbulker.com service.

1. DESCRIPTION OF THE SERVICE AND USE

1.1 – The textbulker.com “service” is an automated text editing service that uses semantics and the integration of various data to provide high quality texts. The writing process uses what is called an AI (artificial intelligence) named GPT3. We use this AI with different algorithms for processing and integrating different data. The goal is to provide the most qualitative result possible.

We use in our various algorithms, third-party tools or data from: GPT3, sites classified on Google and companies registered on Google My Business.

1.2 – The textbulker.com “service”, tools, WordPress plugin and API are provided to you based on the pack purchased; including all software, data, text and other content made available through the site or developed on textbulker.com. These elements are also subject to these conditions.

1.3 – textbulker.com will do its best to make the service available as detailed in the applicable service plan, except for: scheduled downtime, or any unavailability caused by circumstances beyond our control .

1.4 – There is no guaranteed text quality index ratio. The results depend on several individual factors and are related to artificial intelligence, various topics, different data and algorithms.

1.5 – For each generation, the number of words is not guaranteed. The number of words is variable depending on the subjects and different data. We also modify the text thanks to our algorithms to avoid repetitions and to provide you with a more optimized text. Be aware, however, that the word count is usually between 400 and 1300 words for each essay request.

1.6 – In general, if your requests do not comply with these terms of use, we will have to take strict measures such as the termination of your account without notice. Certain subjects are prohibited, in particular themes dealing with practices illegal and/or harmful: gambling, payday loans, illegal substances, weapons development, war, cybercrime, adult industries, spam.

1.7 – We also prohibit the writing of text containing the following themes: harassment, violence, self-harm, sexuality, politics, spam, deception, malware, viruses.

1.8 – You can access your text writing directly on the interface. You have the possibility to export your essays in CSV or TXT.

1.9 – The texts are currently only available in French. English should be available in February 2023.

1.11 – Neither the registration nor the textbulker.com account are transferable.

2. PRIVACY, SECURITY AND DATA BACKUP

2.1 – We make every effort to guarantee you appropriate administrative, physical and technical protection measures to protect the security, confidentiality and integrity of your data and the personal data of your end users. These safeguards include encryption of your data during transmission.

2.2 – The textbulker.com service stores texts and your data without time limit provided that the account remains active. If the account is inactive after 2 years, the texts stored on the platform can be deleted. We therefore recommend that you save the available texts and data.

2.3 – textbulker.com backs up data at regular intervals. If data should however be lost, textbulker.com will endeavor to remedy this problem and/or to restore the situation existing before the loss of the data. textbulker.com is not obligated to do this, however.

2.4 – Through his customer account, the customer can check and modify at any time the registration data and other data provided as part of the registration (address, contact information, etc.). However, the email address on textbulker.com cannot be changed. It corresponds to the account identifier and is linked to the billing system via the Fastspring platform.

3. BILLING, CREDITS AND PLAN CHANGES AND PAYMENTS

3.1 – The textbulker.com service is provided on a pay-per-use basis. There is no subscription. Each algorithm for writing a text has a cost and is defined in advance in the creation of your project.

3.2 – textbulker.com uses the third-party intermediary fastspring.com to manage the processing of MASTERCARD, VISA and PAYPAL credit cards. You can consult the general conditions of use and the privacy policy of this intermediary fastspring.com. These conditions will also always be presented at the time of payment.

3.5 – The intermediary fastspring.com invoices you via a secure online service for the use of the service. FastSpring calculates taxes in real time based on customers' locations and the type of product they purchase. FastSpring automatically applies these taxes at checkout, as required by local regulations in the customer's country. 3.6 – The prices of our different packs are available at this address https://textbulker.com/fr/#price and are subject to change without notice.

3.7 – The service does not use a subscription. You can use the number of credits at your convenience, from month to month. However, for accounting reasons, the total duration of the credits is 2 years.

4. CHANGES AND MODIFICATIONS

4.1 – textbulker.com reserves the right to modify at any time and without notice the content or location of the site and these general conditions. Any use of the site or order following a modification made to the general conditions will imply the acceptance by each user of the said modifications. The most recent and current version of the general conditions will always be available at the following address https://textbulker.com/fr/mentions-legales/.

Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. textbulker.com may also, in the future, offer new services and/or features through the Website (including the release of new tools and resources). These new functionalities and/or services will be subject to the general conditions of this contract.

4.2 – If the customer does not oppose or terminate his contract within one month, his attitude will be considered as consent to the new GCS which will become valid at the end of the period defined by textbulker.com. In the event that the customer objects, textbulker.com is authorized to terminate the contract immediately.

5. MONEY BACK GUARANTEE AND REFUND POLICY

5.1 – Absence of right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period. Given the nature of the Services offered (immediate triggering of indexation upon submission), the contract is deemed definitively concluded upon placing the order by the Customer. No right of withdrawal may therefore be exercised.

5.2 – Refund Policy

The purchase of indexation credits is firm and definitive. No refunds will be made for unused credits..

However, it is possible to cancel writing requests that are not yet being processed by textbulker.com. You will then be automatically credited back to your textbulker credit balance.

6. REFUSAL OF SERVICE

6.1 – We reserve the right to refuse, cancel or suspend the service at our sole discretion and without justification. However, you will be refunded the value of the number of credits remaining in your account.

7. DISCLAIMER

7.1 – textbulker.com cannot be held responsible for system downtime, crashes or loss of data. We cannot be held responsible for any pre-determined estimate of profits a customer would have earned if the textbulker.com service was working.

7.2 – You use textbulker.com, data and texts at your own risk. Indeed, some texts may contain incorrect or inaccurate information. Even if the quality of writing is incredible, there may be errors or anomalies. We therefore strongly recommend that you systematically check the written texts and make a correction if necessary. We can not be held responsible for writing written by artificial intelligence and which could cause possible harm. You are responsible for the content you post.

Failure to comply with the general conditions will result in the automatic deactivation of the account in question. We reserve the right to terminate any account, without notice, for any reason, without restitution, such as textbulker.com hear it.
